This Policy – intended as a notice pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (hereinafter “GDPR”) – is provided by Stefano Maggi, as data controller pursuant to Article 26 GDPR (hereinafter also referred to as “the Controller“), in order to inform the user about the processing of personal data through the cookies used by the website (hereinafter the “Website”).
The Controller informs you that the Website uses cookies in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation; “GDPR”), Italian Legislative Decree no. 196/2003 as amended, Directive 2002/58/EC, the measure issued by the Italian Data Protection Authority (“Privacy Authority”) titled “Identification of simplified procedures for the information notice and acquisition of consent for the use of cookies” dated May 8, 2014, as well as the subsequent “Clarifications regarding the implementation of cookie legislation” dated June 5, 2015 and the “Guidelines on cookies and other tracking tools” dated June 10, 2021.
What are Cookies?
Cookies are packets of information sent by a web server (e.g., the site) to the user’s Internet browser, which are automatically stored on the computer and automatically sent back to the server every time the user accesses the site.
By default, almost all web browsers are set to automatically accept cookies.
Typically, cookies can be installed:
- directly by the owner and/or manager of the website (so-called first-party cookies);
- by entities not managed by the visited website (so-called third-party cookies). According to the guidelines of the Privacy Authority and opinions issued at the European level by the European Data Protection Board (EDPB), Cookies can be categorized as follows:
1. Technical Cookies
Technical Cookies are necessary to carry out the transmission of a communication over an electronic communications network and to provide the service requested by the user. These include:
Session or browsing cookies: these cookies are not stored persistently on the user’s device and are deleted when the browser is closed. They are strictly limited to the transmission of session identifiers necessary to allow safe and efficient website navigation.
Functionality cookies: these allow the website to remember user settings, such as language or privacy preferences, in order to enhance the service and navigation experience.
For these types of Cookies, it is not necessary to obtain the user’s prior and informed consent.
2. Analytical Cookies
Analytical Cookies, as recently emphasized by the Privacy Authority, may be used, among other purposes, to assess the effectiveness of an information society service provided by a publisher, to design a website, or to help measure traffic (i.e., the number of visitors, potentially broken down by geographical area, time slot, or other characteristics).
Similarly, third-party Analytical Cookies do not require prior user consent if they do not lead to the direct identification of the individual (so-called single out), and steps are taken to avoid the use of direct and unique identifiers. In particular, these Cookies must have the following features: (i) the same Cookie must refer to multiple devices to create reasonable uncertainty about the identity of the recipient (e.g., through masking appropriate portions of the IP address), (ii) the use of the Cookies must be limited exclusively to generating aggregate statistics, and such Cookies may be used in relation to a single website or mobile application, without enabling tracking across different sites or apps. Additionally, third parties providing web measurement services to the publisher must not combine the data, even if minimized, with other processing (such as customer files or visit statistics to other sites), nor pass them on to further third parties, unless the statistics generated with the minimized data concern multiple domains, websites, or apps linked to the same publisher or business group.
However, user consent is required for Analytical Cookies installed by third parties without safeguards to minimize the data processing carried out via such Cookies.
3. Profiling Cookies
Profiling Cookies are used to link specific, identified or identifiable individuals to recurring actions or behavioral patterns in using the features offered (patterns), in order to group various profiles into homogeneous clusters of varying sizes, making it possible to provide increasingly personalized services and to send targeted advertising messages, i.e., aligned with the user’s preferences shown during web navigation. Installing Profiling Cookies and processing the resulting personal data is optional, and therefore requires user consent.
